By accessing, browsing, or using the Site, you signify that you have read, understood, and agree to be bound by these Terms of Use, as well as our https://smoku.gr/privacy-policy which is incorporated herein by reference. If you do not agree to these Terms, you must not use or access the Site.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
3.1 Eligibility
You represent and warrant that you are at least 18 years old, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.
3.2 User Accounts (If Applicable)

You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if you violate these Terms.

Upload, post, or transmit any content that is infringing, libelous, defamatory, offensive, or otherwise objectionable. f. All content, features, and functionality on the Site, including text, graphics, logos, images, software, and the design/arrangement thereof, are the exclusive property of Smoku or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.
4.2 User-Generated Content (If Applicable)
If the Site allows users to post content (e.g., comments, reviews, posts): a. You retain all of your ownership rights in your User Content. b. By submitting User Content to the Site, you grant us a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Site and our business. c. You are solely responsible for your User Content and the consequences of posting or publishing it.
5.1 Disclaimer of Warranties
The Site is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied. We do not guarantee that the Site will be uninterrupted, secure, or free from errors, viruses, or other harmful components. Your use of the Site is at your sole risk.
5.2 Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Smoku, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Site.
5.3 Food and Service Disclaimers
Menu Accuracy: All menu items, pricing, availability, and descriptions displayed on the Site are subject to change without notice. While we strive for accuracy, the information may contain errors, and we do not warrant the accuracy or completeness of any menu items or nutritional information.
Allergen Disclaimer: We make every effort to identify ingredients that may cause allergic reactions for those with food allergies. However, there is always a risk of cross-contamination in our kitchen environment. Customers are responsible for informing Smoku staff of any severe allergies when ordering or making reservations. Smoku does not guarantee a complete absence of allergens in any food or beverage item.
Reservations and Availability: Reservations made through the Site are subject to confirmation and availability. We are not liable for any losses or damages arising from a confirmed reservation becoming unavailable due to unforeseen circumstances.
5.4 Private Events and Bookings
If you engage Smoku for private events, special functions, or large group bookings (collectively, “Events”) through the Site, the following specific terms apply unless superseded by a separate, signed Event Contract:
Contract: All confirmed Events require a formal, written Event Contract, which will detail menu, pricing, minimum spend, and specific services.
Deposit: A non-refundable deposit, specified in the Event Contract, is required to secure the date and booking. The Event is not confirmed until the deposit is received and acknowledged by Smoku.
Cancellation: If you cancel an Event, the deposit is generally forfeited. Cancellation terms and any applicable fees will be detailed in the Event Contract based on the notice period provided.
Final Guest Count: The final guaranteed minimum guest count must be provided to Smoku no later than 14 days prior to the Event date. This number will be used for final billing, even if fewer guests attend.
These Terms shall be governed by and construed in accordance with the laws of the Hellenic Republic (Greece), without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts located in Athens, Greece, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
We may terminate or suspend your access to all or part of the Site immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Site will immediately cease.
